Please read these Terms carefully before using XSection.

Acceptance of Terms
By accessing or using XSection (“the Software”), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Software. These Terms apply to all users, including visitors, free trial users, and paid subscribers.
Use of the Software
XSection is a browser-based engineering analysis tool intended for structural engineering analysis and design. Users are responsible for ensuring they have the appropriate knowledge, qualifications, and authority to use the Software for their intended purpose. You agree to use the Software only for lawful purposes and in accordance with these Terms. You may not:
- Use the Software to violate any applicable law or regulation.
- Attempt to copy, modify, reverse engineer, decompile, or otherwise reproduce the Software, except where permitted by applicable law.
- Attempt to bypass or interfere with the Software's security, authentication, licensing, or usage restrictions.
Engineering Responsibility
XSection is intended to assist engineering calculations. It is not a substitute for professional engineering judgement, independent review, or qualified design.
You are solely responsible for verifying the accuracy, suitability, and completeness of all calculations, outputs, and reports produced by the Software before relying on them in design or construction.
The outputs of the Software must be reviewed and accepted by a qualified engineer before being used in any project.
XSection provides calculation tools and reporting, but does not provide engineering advice, certification, or professional opinions. Any reliance on the Software is at your own risk.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access or use. We reserve the right to suspend or terminate accounts that violate these Terms.
Subscription and Billing
Paid plans are billed in advance on a monthly or annual basis as selected at the time of purchase. Subscription fees are non-refundable except where required by applicable law. We reserve the right to change pricing with reasonable notice. Continued use of the Software after a price change constitutes acceptance of the new pricing.
Privacy
Your use of the Software is also governed by our Privacy Policy.
Intellectual Property
The Software, including its code, design, documentation, and branding, is the intellectual property of XSection or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Software for its intended purpose during the term of your subscription or trial period. This licence does not grant you any ownership rights.
Except as expressly permitted by these Terms, no licence or other rights in our intellectual property are granted to you.
Availability
We aim to provide reliable access to the Software, but we do not guarantee uninterrupted or error-free operation. The Software may be temporarily unavailable for maintenance, updates, or due to factors outside our control. We reserve the right to modify or discontinue features with reasonable notice.
We may suspend or restrict access where reasonably necessary to protect the security, integrity, or operation of the Software.
Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under applicable law.
To the maximum extent permitted by law, XSection and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of or inability to use the Software. This includes, without limitation, damages for loss of profits, data, or business opportunity, even if advised of the possibility of such damages.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the Software. Continued use of the Software after changes take effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising out of or in connection with these Terms or the Software is subject to the exclusive jurisdiction of the courts of New South Wales.
